Elections division turns aside Obama nomination challenge<\/a><\/em><\/strong><\/p>\n

The state Division of Elections has turned down a challenge of President Barack Obama\u2019s<\/a> qualifications to be on the election ballot in Alaska<\/a>. The challenge was filed by a <\/strong>Juneau<\/strong><\/a> resident who says the Democratic candidate is not qualified to run for re-election because he\u2019s of mixed race.<\/strong><\/p>\n

It\u2019s not a lawsuit filed in any court. Actually, it\u2019s what\u2019s called a nomination petition objection that was filed directly with the Division of Elections.<\/p>\n

Division director Gail Fenumiai referred the objection to election attorneys within the Department of Law for further review.<\/p>\n

\u201cThis is first time that we\u2019ve received something like this,\u201d says Fenumiai.<\/p>\n

Gordon Warren Epperly is a retired bus driver in Juneau<\/a>. He challenges Barack Obama\u2019s qualifications to be on the ballot during Alaska\u2019s presidential primary and general election. He says that Orly Taitz and others who\u2019ve challenged Obama\u2019s qualifications of being a \u2018natural born citizen\u2019 because of an alleged birth outside of the country went at it all wrong. He says there is no real requirement for a candidate to produce a birth certificate.<\/p>\n

Epperly declined to talk on tape for this story. But in his filing he references the infamous Dred Scott decision<\/a> which he says has never been overturned by the Supreme Court. He says Negros or Mulattos<\/a> (he pronounces it mull-EYE-ttos) were not eligible to be citizens until the Fourteen Amendment<\/a> was ratified in 1868. Even then, what Epperly calls \u2018purported\u2019 ratification of the amendment only allowed for civil rights, not political rights that allowed them and their descendants to hold federal office…<\/p>\n
