{"id":27917,"date":"2013-01-29T01:57:07","date_gmt":"2013-01-29T01:57:07","guid":{"rendered":"http:\/\/www.mixedracestudies.org\/wordpress\/?p=27917"},"modified":"2013-01-29T01:57:07","modified_gmt":"2013-01-29T01:57:07","slug":"beyond-selma-to-stonewall","status":"publish","type":"post","link":"https:\/\/mixedracestudies.org\/wp\/?p=27917","title":{"rendered":"Beyond Selma-to-Stonewall"},"content":{"rendered":"<p><strong><em><a href=\"www.nytimes.com\/2013\/01\/28\/opinion\/beyond-mr-obamas-inaugural-message-on-gay-rights.html\" target=\"_blank\">Beyond Selma-to-Stonewall<\/a><\/em><\/strong><\/p>\n<p><a href=\"www.nytimes.com\" target=\"_blank\">The New York Times<\/a><br \/>\n2013-01-27<\/p>\n<p>By including gay rights in the arc of the struggle for civil rights \u2014 the road \u201cthrough Seneca Falls and Selma and Stonewall\u201d \u2014 <a href=\"http:\/\/en.wikipedia.org\/wiki\/Barack_Obama\" target=\"_blank\">President Obama<\/a> linked his presidency to ending antigay discrimination and underscored the legal wrong of denying gay people the freedom to marry.<\/p>\n<p>\u00a0\u201cOur journey is not complete until our gay brothers and sisters are treated like anyone else under the law,\u201d Mr. Obama famously said in <a href=\"http:\/\/www.nytimes.com\/2013\/01\/21\/us\/politics\/obamas-second-inaugural-speech.html\" target=\"_blank\">his second Inaugural Address<\/a>, \u201cfor if we are truly created equal, then surely the love we commit to one another must be equal as well.\u201d<\/p>\n<p>Now that Mr. Obama has declared that he believes denying gay people the right to wed is not only unfair and morally wrong but also legally unsupportable, the urgent question is how he will translate his words into action. To start, he should have his solicitor general file a brief in the <a href=\"http:\/\/en.wikipedia.org\/wiki\/California_Proposition_8\" target=\"_blank\">Proposition 8<\/a> case being argued before the Supreme Court in March, saying that California\u2019s voter-approved ban on same-sex marriage is unconstitutional&#8230;<\/p>\n<p>&#8230;ust a day after the inauguration, Mr. Obama\u2019s spokesman, Jay Carney, said that while Mr. Obama supports same-sex marriage as a policy matter, <strong>the president still believes it is an issue for individual states to decide.<\/strong> That was Mr. Obama\u2019s formulation when he first announced his support for same-sex marriage in May, and even then it made no sense, except perhaps as political cover approaching the general election campaign.<\/p>\n<p>Marriage is traditionally regulated by the states, <strong>but there are constitutional limits on what states may do.<\/strong> The Supreme Court\u2019s 1967 ruling in <em><a href=\"http:\/\/www.mixedracestudies.org\/?p=415\" target=\"_blank\">Loving v.
