In cases out of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Virginia\" target=\"_blank\">Virginia<\/a>, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Texas\" target=\"_blank\">Texas<\/a>, and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Minnesota\" target=\"_blank\">Minnesota<\/a>, courts were presented with claims brought by a mixed race plaintiff but gave scant if any attention to this complex identity, preferring to simply assign the plaintiff a category that allowed for easy application of the McDonnell Douglas protected class paradigm. In these cases, the courts typically noted that the plaintiffs identified themselves as \u201cmultiracial,\u201d or \u201cbiracial,\u201d and then proceeded to describe them simply as \u201cblack\u201d or \u201cAfrican American\u201d for the remainder of the opinion. This was the case even where the alleged discrimination consisted of harassing statements that seemed to have been directed specifically at the plaintiff\u2019s mixed race status.<\/p><\/blockquote>\n<p><a href=\"http:\/\/www.fox.temple.edu\/mcm_people\/leora-eisenstadt\/\" target=\"_blank\">Leora F.
