Herring also told clerks they must issue a marriage license \u201cregardless of an applicant\u2019s answer or non-answer to that inquiry.\u201d<\/p>\n<p>The new guidance comes about a week after three couples filed a <a href=\"https:\/\/www.washingtonpost.com\/local\/legal-issues\/aryan-and-octoroon-couples-challenge-racial-labels-to-get-married-in-virginia\/2019\/09\/06\/0c41d6bc-ca73-11e9-a4f3-c081a126de70_story.html\" target=\"_blank\" rel=\"noopener\">federal lawsuit<\/a> alleging the required disclosure of race is unconstitutional because it violates the <a href=\"https:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noopener\">First<\/a>, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Thirteenth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noopener\">13th<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Fourteenth_Amendment_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noopener\">14th amendments<\/a>.<\/p>\n<p>\u201cWe were happy to help quickly resolve this issue and get these couples what they asked for,\u201d Herring said in his statement. \u201cThese changes will ensure that no Virginian will be forced to label themselves to get married.\u201d&#8230;<\/p>\n<p>Read the entire article <a href=\"https:\/\/www.washingtonpost.com\/local\/social-issues\/virginia-couples-no-longer-have-to-disclose-race-on-marriage-license-applications-state-attorney-general-says\/2019\/09\/14\/4f40d578-d6fb-11e9-9610-fb56c5522e1c_story.html\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Under a new policy \u2014 which Attorney General Mark Herring detailed in emails to court clerks and members of the media late Friday \u2014 people getting married will be able to select \u201cDeclined to Answer\u201d in a box asking about race.
