What’s in a Name? Mixed-Race Families and Resistance to Racial Codification in Eighteenth-Century France

The Saint-Domingue planter Aimé-Benjamin Fleuriau did not simply leave colonialism behind when he returned to his hometown La Rochelle: he literally brought some of its complications with him. Five of his mixed-race children by his former slave Jeanne arrived with or soon after their white father. The very existence of this family complicated an increasingly easy equation between blackness and slavery, and for both the planter and his children, family ties shaped their experience of race and status. In the midst of growing racial paranoia in France and legislation that regulated all people of color, Fleuriau and his daughter Marie-Jeanne privileged family over race as a means of carving out a position of autonomy for themselves in French society, albeit in very different ways and for very different reasons. In doing so, they shaped what the category “family” meant in France.

Aimé-Benjamin Fleuriau, ex–résident blanc de Saint-Domingue, au lieu d’abandonner le colonialisme après son retour à La Rochelle, a rapporté avec lui certaines des complications coloniales. Cinq des enfants métisses qu’il a eus avec son ancienne esclave Jeanne sont arrivés avec lui, ou peu après. L’existence même de cette famille a compliqué le lien évident entre la négritude et l’esclavage. Pour le planteur et ses enfants les liens familiaux ont informé leur manière d’assumer leur race et leur position sociale. Au milieu de la paranoïa raciale croissante en France au dixhuitième siècle et la législation qui réglementait tous gens de couleur, Fleuriau et sa fille Marie-Jeanne ont privilégié les liens familiaux plutôt que raciaux afin de créer une position d’autonomie dans la société française, bien que par des moyens et pour des raisons très différents. Ils ont ainsi façonné la catégorie « famille » en France.

Caroline Beschea-Fache, a native of northern France, joins the French Department as a specialist in Métissage, the study of biracialism, multiracialism, and diversity as applied to literature, social studies, and political science. Her research and teaching interests also include modern Francophone literature, cinema, and the construction of identity in France for immigrants. Beschea-Fache holds a master’s degree in movie translation from the University of Lille, where she also completed her undergraduate work. In 2000, she began her pursuit of a master’s degree in French at Indiana University, where she wrote her dissertation on the representation of biracial characters in Francophone literature…

This book recreates the lives of the children born of relationships between French men and African women from the time France colonized much of West Africa towards the end of the 19th century, until independence in 1960. Set within the context of the history of miscegenation in colonial French West Africa, the study focuses upon the lives and identities of the resulting mixed-race or métis population, and their struggle to overcome the handicaps they faced in a racially divided society. This author has drawn an evaluation of the impact and importance of French racial theories, and offers a critical discussion of colonial policies in such areas as citizenship and education, providing insights into problems of identity in colonial society.

From 1890–1956, non-governmental welfare agencies worked with the French colonial government in Indochina to remove Eurasian children, who had been abandoned by their French fathers, from their Vietnamese mothers and the Vietnamese cultural environment. In an era marked by historical exigencies, perceived threats to white prestige, and inherent challenges to the colonial patriarchy, such children were believed to be a threat to colonial security and white prestige. The racial formations of abandoned Eurasian children in colonial Indochina changed repeatedly in response to these threats. Drawing from the rhetoric of racial sciences and led by anxieties over changes colonial security, French civilians increasingly and colonial government administrators increasingly made the case that these children where white and must be removed from their Vietnamese mothers’ care, using force if necessary.

Russwurm was born in Port Antonio, Jamaica, the illegitimate son of a white planter and a black slave. His father, John Russwurm, of a wealthy Virginia family, went to Jamaica after completing his education in England. He sent his son, John Brown Russwurm, to Quebec at age eight so that he might receive a good education. Soon after moving to Maine, his father married Susan Blanchard. Russwurm then came to live with his father’s family, where he was accepted by his step-mother as one of her own. Russwurm stayed with the family even after his father died, continuing his education at Hebron Academy in Hebron, Maine. His step-mother and her new husband helped him to enroll at Bowdoin in 1824….

Can Louisiana tell us something about civil law vs. common law regimes of slavery? What can the Louisiana experience tell us about a civil law jurisdiction “transplanted” in a common-law country? Louisiana is unique among American states in having been governed first by France, then by Spain, before becoming a U.S. territory and state in the nineteenth century. Unlike other slave states, it operated under a civil code, first the Digest of 1808, and then the Code of 1825. With regard to the regulation of slaves, these codes also incorporated a “Black Code,” first adopted in 1806, which owed a great deal to both French and Spanish law. Comparisons of Louisiana with other slave states tend to emphasize the uniqueness of New Orleans’ three-tier caste system, with a significant population of gens de couleur libre (free people of color), and the ameliorative influence of Spanish law. This reflects more general assumptions about comparative race and slavery in the Americas, based on the work of Frank Tannenbaum and other historians of an earlier generation, who drew sharp contrasts between slavery in British and Spanish America. How does the comparison shift if we turn our attention away from slave codes, where Tannenbaum focused, to the “law in action”? At the local level, one can see the way slaves took advantage of the gap between rules and enforcement, and to fathom racial meanings at the level of day-to-day interactions rather than comparisions of formal rules. This essay surveys three areas of law involving slaves – manumission, racial identity, and “redhibition” (breach of warranty) – to compare Louisiana to other jurisdictions, and particularly to its common-law neighbors.

…The first major slave codes in the North American colonies date to 1680-82. They draw numerous distinctions on the basis of race rather than status, including laws against carrying arms and against leaving the owner’s plantations without a certificate. A penalty of thirty lashes met “any Negro” who “lift up his hand against any Christian.” In 1691, English women were fined for having a bastard child with a negro. In 1705, all mulatto children were made servants to the age of 31 in Virginia; Maryland and North Carolina adopted the same rule within the next several decades.

By the time the U.S. became a republic, only those of African descent were slaves, and all whites were free. Yet there were a significant number of individuals and entire communities of mixed ancestry with ambiguous racial identity along the Eastern seaboard. In the southeast, Indian tribes both absorbed runaway slaves and, in the late eighteenth century, adopted African slavery. In addition to the 12,000 people designated in the Census as “free people of color” in Virginia, there were 8000 in Maryland in 1790, 5000 in North Carolina, 1800 in South Carolina, and 400 in Georgia…

The chapter analyses the positionalities of the mixed-race female protagonists of each film and the visualisation of their mixed-race identity.  It considers aspects of their struggle for self-definition against the director’s visual clues about their ‘true’ racial space.  It also explores the possibility in these films for a representation of mixed identity that surpasses the stereotypes of the ‘tragic mulatto’ torn between black and white worlds (as represented by mothers in the American films and lovers/parents in the French film).  Finally the article – as with my thesis – considers the limitations of American cinema in transcending binaried representations of race and the alternatives which French cinema offers, in order to consider the possibility for a mixed-race representative model which would visualise the multiplicity and ‘Third Space’, as Homi K. Bhabha put it, of mixed-race identity.

This essay surveys and compares American and French attitudes toward miscegenation or métissage since the extensive contacts with non-European peoples that began in the Atlantic world of the seventeenth century. It develops a typology of possible responses to such race mixture and argues that the English colonies that became the United States quickly developed a highly restrictive attitude toward racial intermarriage, especially between blacks and whites, that has persisted through most of American history and is still influential today. The French in the eighteenth, nineteenth and early-to-mid twentieth century often adhered to concepts of race as innate or biologically determined, but their attitudes toward interracial marriage or concubinage tended to be more pragmatic. In some situations French theorists of race and empire defended and even advocated certain forms of métissage. The difference can be summed up as follows: white Americans have historically pursued the ideal of racial purity with much more intensity and consistency than the French. The difference is best explained with reference to the unique status of African-Americans as a colour-coded pariah group with no real equivalent in metropolitan France.

In its most traditional moral and legal conception, marriage had for consequence to erase the crime of cohabitation and dissoluteness. Independentently of geographic space and by virtue of the principle of the unity of French laws and customs, the institution of marriage could not be left supplant under colonial law and order. In 1685, the Edict administering the rights and the duties of slaves and emancipated slaves as well as their relationships with white people in the French colonies established legitimacy and religious rules. However, the rigidity of statutory tripartition of the population could not concretely integrate these justifiable, legally valid but socially prohibited unions. The first legal ban was introduced into the Code of Louisiana in 1724 and the second was imposed by the prescription of April, 1778 for continental France. Meanwhile, the Monarchy was never resolved to reform article 9 of the Code of 1685. In doing so, the administration strategically restricted the civil and professional rights of those who chose to go against the social misalliance. It isn’t until the promulgation of the Civil code of 1805 that the restriction based on race and status is finally unified. But once again even if the principle is acquired, its execution remains unpredictable: it extends to all people, of color or black, in colonies but only to black people in metropolitan France. However, for more than two centuries, the legislator, conscientiously maintained a flaw in the prohibition: whether it be in the colonies or in France, these marriages will never be punished by nullity. This absence of penalty will finally allow the Supreme Court and the Abolitionists to declare the legal ban on interracial marriages invalid and to overrule it.

In 1755 the merchant Aimé-Benjamin Fleuriau returned to his native city of La Rochelle, a bustling port on France’s Atlantic coast, after twenty years in the colonies where he made his fortune in indigo and sugar produced by slaves who worked his plantation. But he did not return alone: he brought five of his mixed-race children with him, his sons and daughters by a woman named Jeanne, one of his former slaves. The children’s gender determined their varied paths: the boys returned to Saint-Domingue where they supervised their father’s plantation, while the girls remained close to their father in La Rochelle. With his support, his daughters Jeanne-Marie and Marie-Charlotte set up house just a few blocks from where Aimé-Benjamin lived in the most splendid house in town with his new, white French wife and children. In spite of the ocean between them, Jeanne-Marie and Marie-Charlotte remained in touch with their brothers in the colonies, and made every effort to reinforce these family ties that distance threatened to pull asunder. In doing so, they drew on family strategies long-established in Europe and deployed them to define their own trans-oceanic, multi-racial family unit. This paper argues that intimacy provides a critical lens through which to view the Atlantic world. It was in the context of the family that enduring relationships between white men and people of color were most common, and examining how such intimate family relationships were constructed and maintained provides insight into how Europeans, including black and mixed-race Europeans, participated in and shaped the Black Atlantic. The results of such a view are sometimes surprising: free women of color, who might at first glance seem among the least influential members of a society that valued rank, name, and status, found ways to shape family structures and strategies.
